Hiring freelancers often seems like a fast, flexible and effective solution for capacity problems or a lack of specialist knowledge. But this hiring also has risks: are the hired workers really freelancers, or is it a case of bogus self-employment/disguised employment?

 

The laws and regulations surrounding bogus self-employment are constantly changing. New legislation to prevent bogus self-employment is currently still under discussion and will probably mot be implemented before 2026. However, in the meantime the Dutch Tax Authorities have intensified enforcement of bogus self-employment as of 1 January 2025.

 

This implies that principals must take action now to properly map their self-employed population. What situations and contracts are there? Are they really self-employed or is it disguised employment? Recent court decisions contain criteria to determine whether or not it really is self-employment.  What are the risks and what measures must be taken to reduce those risks?

Work cost scheme / WKR toolkit

The Work Costs Scheme (hereinafter referred to as “WKR”) regulates the tax treatment of the compensation and benefits provided by the employer to employees. Employers can reimburse, provide or provide goods to their employees tax-free up to a certain amount, which depends on the taxable payroll. If this amount is exceeded, the employer is liable for 80% final levy on the excess. It is therefore important for employers to set up and monitor the WKR properly in order to make the best possible use of it and to pay as little final levy as possible.

Exchange scheme for gross compensation and benefits into net compensation and benefits

With an exchange scheme, employees can partly put together their own employment conditions package in a tax friendly way. Under certain conditions, part of the gross salary can be exchanged for, for example, a bicycle, extra vacation days, a training budget or more pension contributions. An exchange scheme can be advantageous for both employer and employee, partly because less payroll tax and fewer social security contributions are due by employee and employer.

 

An exchange scheme must meet various conditions. Werque.nu has extensive experience in drafting and implementing exchange schemes in various forms for employers.

Working from home / remote working / digitals nomads

Working from home is becoming increasingly common. Working from home has both advantages and disadvantages, for the employee and for the employer. It is important to arrange working from home as well as possible, in consultation between employer and employee. Various aspects must be taken into account: for example, does the home workplace meet the occupational health and safety requirements, can home working costs be reimbursed in a tax-friendly manner, is there sufficient and good communication between employees and with management, what does working from home mean for the employee's performance and how is the employee assessed if he/she mainly works from home, is the ICT environment sufficiently secured, is working from home temporary or will it become structural, how do we record the agreements about working from home, etc. 

It is even more complex if the home worker does not live and work in the same country, real remote working or a digital nomad.

 

Werque.nu has developed a home working toolkit, also for situations in which the employee is living and working in different countries on a temporary or permanent base (remote working, digital nomads). The toolkit answers the above questions and other questions, contains an overview of the laws and regulations that apply to home/remote working and provides tax optimization options for home/remote working allowances. Settlement scheme

Termination of the employment contract by means of a departure arrangement laid down in a settlement agreement is often preferred by employer and employee. The advantages are that the termination can take place in good mutual consultation, that there are no lengthy legal procedures and that the employee is entitled to unemployment benefits if the settlement agreement is approached correctly and formulated correctly.
 

The creation of such a settlement agreement and severance agreement are delicate. Werque.nu supports and advises both employers and individual employees in this area.
